We are representing Fitbug in a suit against health gadget maker Fitbit, alleging trademark infringement, as well as unfair competition and unfair business practices, arguing that Fitbit's name is confusingly similar to Fitbug. Launched in 2005, Fitbug is a London-based e-health company which offers a fitness-tracking service via electronic tracking devices, as well as Web-based nutrition advice and digital coaching. Fitbit debuted in 2009 and offers products and services that are nearly identical to the ones offered by Fitbug. The case appeared in the Wall Street Journal article “Fitbug Files Complaint Against Fitbit, Alleging Trademark Infringement as well as Unfair Competition and Business Practices.”
Mark Rosenberg, a partner in the Intellectual Property Practice, is handling the matter.
